Art. 17 Lawfulness of not following orders
Art. 17 – Lawfulness of not following orders
An act under Articles 12 to 16 is not punishable if the order:
1. violates human dignity,
2. was given by an person or position lacking the authority to do so,
3. became ineffective consequently to another order,
4. is overtaken by a change of circumstances and its observance would entail a risk of substantial disadvantage (Art. 2, No. 4),
5. bears no relation to the military service or
6. entails the commission of an act punishable by court.
