Law or Regulations: Military Penal Code (Decree Law No 34 of 2002)


Art. (Extracts in English and Arabic)


Article 12
The hereunder persons shall be subject to provisions of this law:
a- Officers and soldiers of the Defence Force
b- Persons dispatched on study missions by the Defence Force in any academic educational, military or civilian professional establishment or institution inside the Kingdom of Bahrain or abroad
c- Civilian workers within the Defence Force
d- Officers and soldiers in the Reserve Force once summoned for service and during service, by virtue of the Reserve Force Law
e- Military personnel of allied forces and civilians adjoining them, if living on the territories of the Kingdom of Bahrain, unless otherwise provided for in international treaties or conventions
f- Prisoners of war.
المادة (12)
يخضع لأحكام هذا القانون الأشخاص الآتي ذكرهم:
أ-ضباط وأفراد قوة الدفاع.
ب- المبتعثون للدراسة من قبل قوة الدفاع لأية مؤسسة أو منشأة تعليمية أكاديمية أو مهنية عسكرية أو مدنية داخل مملكة البحرين أو خارجها.
ج-العاملون المدنيون في قوة الدفاع.
د -ضباط وأفراد القوة الاحتياطية بمجرد استدعائهم للخدمة الفعلية وأثناء تواجدهم فيها وفقاً لقانون القوة الاحتياطية.
هـ-العسكريون من القوات الحليفة, والملحقون بهم من المدنيين إذا كانوا يقيمون في أراضي مملكة البحرين, إلا إذا كانت هناك معاهدات أو اتفاقيات دولية تقضي بخلاف ذلك.
وـ أسرى الحرب.

Article 13
Any person subject to this law and having committed any of the crimes provided for in the Penal Code or any other code of law, as a main actor or associate, either inside the Kingdom or abroad, shall be considered as perpetrator of a military offence, shall be subject to the jurisdiction of military courts, and shall be liable to the penalty in laws providing for the same.
المادة (13)
يعد مرتكبا لجريمة عسكرية ويخضع لاختصاص المحاكم العسكرية كل شخص خاضع لأحكام هذا القانون أرتكب إحدى الجرائم المنصوص عليها في قانون العقوبات أو في أي قانون آخر بصفته فاعلا أو شريكا داخل المملكة أو خارجها, ويعاقب بالعقوبة المقررة لها في تلك القوانين
Article 95
Any person subject to provisions of this law and having committed any of the following crimes shall be liable to the death penalty:

(i) The superior failed to take all necessary measures within his power to execute the operations he was entrusted with, or to prepare, execute, complete or secure the operations.


المادة (95)
يعاقب بالإعدام كل شخص خاضع لأحكام هذا القانون ارتكب أحدى الجرائم الآتية

ط-لم يقم عمدا بواجب العمليات المكلف به أو بالإعداد له أو بتنفيذه أو بإتمامه أو بتأمينه

Article 101
"Any combatant who, in a military zone, plunders a dead, wounded or sick soldier, even an enemy soldier, shall be liable to life imprisonment".
المادة (101)
يعاقب بالسجن المؤبد كل من أقدم في منطقة العمليات العسكرية على سرقة عسكري ميت أو جريح أو مريض حتى ولو كان من الأعداء.
Article 102
"Any combatant who commits an act of violence against a sick or wounded defenceless soldier shall be liable to life imprisonment".
المادة (102)
يعاقب بالسجن المؤبد كل من أوقع عملا من أعمال العنف بعسكري جريح أو مريض لا يقوى على الدفاع عن نفسه.
