State: Azerbaijan Law or Regulations: Law of the Republic of Azerbaijan "on the changes and additions to the criminal code of the Republic of Azerbaijan and the code of administrative offences of the Republic of Azerbaijan" in keeping with the law "on the use and protection of the red cross and red crescent emblems"

Hereby Milli Mejlis of the Republic of Azerbaijan takes a decision that:
I. The following additions and changes are to be done to the Criminal Code of the Republic of Azerbaijan (The Compendium of Legislative Acts of the Republic of Azerbaijan, 2000, # 4, art. 251; The Compendium of Legislative Acts of the Republic of Azerbaijan, 2001, # 1, art. 24; The Compendium of Legislative Acts of the Republic of Azerbaijan, 2001, # 7, art. 455; The Compendium of Legislative Acts of the Republic of Azerbaijan, 2002, # 1, art. 9):
1. In the article 116.0.3 the words "Red Cross or Red Crescent" ([transcription not possible]) are to be replaced by the words "Red Cross or Red Crescent" ([transcription not possible]); after the word "transports" the words "medical property" are to be added.
2. The disposition of the article 119.1 is to be given in the following wording :
"The use by the persons not entitled to in time of armed conflict:
- of the emblems of the Red Cross and the Red Crescent as the protective sign or as the distinctive sign,
- of the distinctive signals,
- of the emblems and the names of the Red Cross and the Red Crescent for the purposes discrepant with the Principles of the International Red Cross and Red Crescent Movement,
- of any other similar signals, which could be considered as the emblems of the Red Cross and the Red Crescent used as the protective sign."
II. The following change is to be done to the Code of Administrative Offences of the Republic of Azerbaijan (The Compendium of Legislative Acts of the Republic of Azerbaijan, 2000, # 8, art. 584; The Compendium of Legislative Acts of the Republic of Azerbaijan, 2001, # 1, art. 24; The Compendium of Legislative Acts of the Republic of Azerbaijan, 2001, # 7, art. 455; The Compendium of Legislative Acts of the Republic of Azerbaijan, 2001, # 11, art. 680, 696; The Compendium of Legislative Acts of the Republic of Azerbaijan, 2002, # 1, art. 9).
The name and the disposition of the article 342 are to be given in the following wording:
"Article 342. The illegal use of the emblems, the names of the Red Cross and the Red Crescent and of the distinctive signals.
The use of the emblems and the names of the Red Cross and the Red Crescent in the names and trade marks of the juridical persons,
the use in time of peace:
- of the emblems of the Red Cross and the Red Crescent as the protective sign or as the distinctive sign,
- of the distinctive signals,
- of the emblems and the names of the Red Cross and the Red Crescent for the purposes discrepant with the Principles of the International Red Cross and Red Crescent Movement,
- of any other similar signals, which could be considered as the emblems of the Red Cross and the Red Crescent used as the protective sign."
III. The present law enters into force from the date of its publication.
