Section IV : On the rights and duties of the belligerent with regard to enemy property - Art. 39.
Art. 39. Enemy cargo found on board the ships detained under Articles 37
may likewise be held. It must be restored after the termination of the war without payment of indemnity, unless requisitioned on payment of compensation.
The same rule is applicable to goods which are contraband of war found on board the vessels mentioned in Articles 36
, even when these vessels are not subject to capture.
