Commentary - Art. 2. Annex II : Regulations concerning mixed medical commissions (see Article 112)

    [p.658] The present provision, which states that the neutral members shall be appointed by the International Committee of the Red Cross, was not included in the 1929 Convention. In many cases during the Second World War, however, the belligerent countries asked the International Committee to make such appointments. The place of residence of the members appointed does not matter provided it is not in a country at war with the Detaining Power; as a general rule, the two neutral members of the Commission should belong to the same country (1).
    Article 5 below provides, as an alternative solution, that the neutral members may be appointed by the Protecting Power.
