Convention (III) relative to the Treatment of Prisoners of War. Geneva, 12 August 1949.
. -- ALTERNATIVE SOLUTION
[p.663] As already mentioned in connection with Articles 3
, the present Article covers the contingency in which it proves impossible to find a sufficient number of neutral doctors. In that case, with the agreement of the Protecting Power, the duties of the Mixed Medical Commissions will be carried out by doctors belonging to the Detaining Power. There is no express provision here for any action by the International Committee of the Red Cross, but it is understood that the Committee continues to have the general responsibilities conferred on it by the Convention, in particular by Article 9
, which states: "The provisions of the present Convention constitute no obstacle to the humanitarian activities which the International Committee of the Red Cross ... may ... undertake for the protection of prisoners of war ..."
