Section IV : On the rights and duties of the belligerent with regard to enemy property - Art. 37.
Art. 37. The public or private vessel unable, owing to circumstances of ' force majeure, ' to leave the enemy port within the period contemplated in the preceding article
, cannot be captured.
The belligerent may only detain it without payment of compensation but subject to the obligation of restoring it after the war, or requisition it on payment of compensation.
