The International Committee of the Red Cross (ICRC) seeks a senior legal consultant to analyse and recommend how to address legal barriers faced by families of missing persons, particularly from the Marawi siege. The consultant will develop policy recommendations, engage with key stakeholders, and facilitate a government roundtable to promote a streamlined legal process.

Responsibilities

  • Conduct an in-depth assessment of legal challenges related to pensions, property rights, bank accounts, remarriage, and other issues.
  • Engage with key government agencies, families of the Missing and legal practitioners to understand existing frameworks.
  • Identify gaps and inconsistencies in current policies and procedures.
  • Develop a roadmap to advocate for access to a recognized certificate of presumed death for the Missing Person cases related to the Marawi conflict (short-term) and for a "Certificate of Absence" or streamlined legal solution, long term.
  • Facilitate discussions at a government roundtable to present recommendations, encourage implementation and achieve tangible commitments

Required profile

  • Expertise in family law, inheritance rights, banking law, and administrative procedures (especially to obtain any earned benefits from the government, etc.)
  • Strong network with government decision makers and policy makers and deep understanding of the legal and administrative frameworks related to missing persons and persons affected by conflict and violence in the Philippines
  • Preferably a former high-level government official with experience in legal frameworks
  • Proven experience in government engagement and policy advocacy
  • Strong analytical and report writing skills
  • Ability to facilitate high-level discussions
