The Treatment of Detainees: From the Perspective of Islamic Law

Even during an armed conflict, the enemy must be treated humanely. Today, the rules of humane treatment of detainees are set out in international humanitarian law (IHL). However, long before these rules were codified, Islamic law provided protections for soldiers captured in the context of an armed conflict. This document provides the Islamic law perspective to a concise set of IHL rules that non-state armed groups must respect and should integrate into their operational guidance as a minimum standard. These rules are not an exhaustive list of the IHL or Islamic law rules that apply to non-state armed groups, but a list of key rules that every fighter has to comply with.
